About the webinar

Applying for a court order to administer a deceased estate when a person dies without a will is often complicated. The application process can raise a variety of concerns and issues for those involved in the preparation of the application. Knowing what matters need to be considered, recognized and addressed and supported by evidence and what is not relevant or can excluded, when making an application, is not always clear.

This ONDEMAND webinar examines, and addresses, the following aspects of applying for Letters of Administration on Intestacy:

-          how to determine who is entitled to apply;
-          the form of the application;
-          clearing off other beneficiaries;
-          whether it is necessary to obtain consents;
-          establishing the relationship status of spouse, civil union partner or de facto partners and implications for notice of choice of option A or B;
-          making Status of Children Act inquiries;
-          establishing entitlement to apply when the person entitled is incapacitated or predeceased the deceased;
-          obtaining grants for use and benefit another person or their estate;
-          completing the affidavit in support of the application

He is a co-author of Wills and Succession and of Dobbie’s Probate and Administration Practice, 6th edition and the author of Dobbies’ Probate and Administration Practice Updated Forms 2017 all published by LexisNexis.
