About the Series
The webinar series Estate Administration: Practice Procedure and Process provides attendees with practical insights into selected aspects of probate and administration; how to address problems; how to determine what evidence must be produced and circumstances when it is not required.
The series has been developed for those legal professionals who are directly involved in dealing with clients, determining the nature of the application required to be made, and in the preparation of applications with supporting documentation.
About the webinar
Applying for a court order to administer a deceased estate when a person dies without a will is often complicated. The application process can raise a variety of concerns and issues for those involved in the preparation of the application. Knowing what matters need to be considered, recognized and addressed and supported by evidence and what is not relevant or can excluded, when making an application, is not always clear.
This ONDEMAND webinar examines, and addresses, the following aspects of applying for Letters of Administration on Intestacy:
- how to determine who is entitled to apply;
- the form of the application;
- clearing off other beneficiaries;
- whether it is necessary to obtain consents;
- establishing the relationship status of spouse, civil union partner or de facto partners and implications for notice of choice of option A or B;
- making Status of Children Act inquiries;
- establishing entitlement to apply when the person entitled is incapacitated or predeceased the deceased;
- obtaining grants for use and benefit another person or their estate;
- completing the affidavit in support of the application
Registered attendees will receive a checklist to refer to when applying for Letters of Administration without a will .
Recorded: 1st November 2018
